These Terms are a plain-language draft pending final attorney review.
By using platfory.ai or the Platfory extension (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
The Service is operated by, and you contract with, Oleksii Yakubenko, an individual entrepreneur (empresário em nome individual) registered in Portugal (NIF 320760839, business address R. Saraiva de Carvalho 1C, 1250-240 Lisboa, Portugal), trading as "Platfory" ("Platfory", "we", "us").
You must be at least 18 years old and able to form a binding contract. You sign in with GitHub or Google; you are responsible for activity under your account and for keeping it secure. One person or entity may not operate multiple accounts to abuse earnings, referrals, or the auction.
Platfory shows a single sponsored line in the wait-state of supported AI coding tools. Advertisers bid in an auction; developers earn a share of the resulting ad revenue. We may change, suspend, or discontinue features at any time.
The advertiser service is offered to businesses and professionals acting in a commercial capacity only; it is not a consumer service. You represent and warrant that you hold all rights, licences, and consents needed to run the creative and its destination; that both are truthful, not misleading, and comply with all applicable laws (including EU and Portuguese consumer-protection, advertising, intellectual-property, and unfair-competition rules); that they infringe no third party's rights; and that they comply with Section 6 and our payment processors' rules. You will defend, indemnify, and hold harmless Platfory from any claim, loss, fine, or expense (including reasonable legal fees) arising from your creative, its destination, your products or services, or your breach of these Terms. You are the data controller for any personal data on your destination pages. Prepaid balance funds campaign spend only; unspent, validly-held balance is refundable on request less amounts already committed or owed. Invoices are issued for payments, with VAT applied where required.
Ads run in a professional developer environment and settle through third-party payment processors with their own restrictions. To protect that surface and those processors, the following categories of advertising are not permitted, whether in the creative line or the destination:
We screen creatives automatically and by human review, and may reject, pause, remove, or refund any campaign at our discretion. This list is not exhaustive; we may update it as needed.
We grant you a limited, revocable, non-transferable license to use the extension. Before it integrates with any tool, it shows you exactly what will change and asks your consent per tool. You authorize those changes. Updates are signature-verified. Uninstalling, or running "Platfory: Restore", reverts all changes. You may not tamper with the extension's integrity checks or use it to defraud the auction.
Referral bonuses are paid only after a referred user reaches the disclosed real-earnings threshold. Self-referrals, fake accounts, and other abuse void referrals and any related bonuses.
You agree not to: generate fake or automated impressions/clicks; run bots or scripts to inflate earnings; reverse engineer the Service to abuse it; interfere with security or other users; or violate any law.
Platfory integrates with third-party AI tools through their supported extension points and is not affiliated with, endorsed by, or sponsored by their makers. Your use of GitHub, Stripe, and those AI tools is governed by their own terms. You are responsible for complying with them.
Platfory and its content are owned by us or our licensors. These Terms grant you no rights except as expressly stated.
The Service is provided "as is" and "as available", without warranties of any kind to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or any particular earnings.
To the maximum extent permitted by law, Platfory will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Our total liability for any claim will not exceed the greater of the amounts we paid you in the prior three months or USD 100 (or local-currency equivalent). Nothing in these Terms limits liability that cannot be limited under applicable law, including for fraud, gross negligence, or death or personal injury, or a consumer's mandatory statutory rights.
You will indemnify Platfory against claims arising from your misuse of the Service, your content, or your violation of these Terms or law.
You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or abuse the Service. Unpaid, validly-earned balances remain payable subject to our fraud checks and payout minimum.
We may update these Terms. We will give reasonable prior notice of material changes and, where they affect you, a chance to stop using the Service before they take effect. These Terms are governed by the laws of Portugal, excluding its conflict-of-laws rules and the UN CISG. The courts of Lisbon, Portugal have exclusive jurisdiction, except that if you are a consumer resident in the EU, nothing here deprives you of the mandatory protections of, or the courts of, your country of residence. EU consumers may also use the European Commission ODR platform at ec.europa.eu/consumers/odr.
